U.S. District Court Judge, Mikel H. Williams, has released a 34-page document on the Simplot Smoky Canyon Min lawsuit.
The court has ruled in favor of allowing the mine to expand operations. The ruling noted that the federal agencies allowed for proper study and notice of decisions.
The court also noted that the Idaho Department of Environmental Quality was satisfied that Simplot had taken the necessary steps to re-mediate for any possible selenium contamination.
