The 9th U.S. Circuit Court of Appeals upheld a lower court ruling regarding expansion approval at Simplot’s Smoky Canyon facility.  According to the court, the Bureau of Land Management and the U.S Forest Service both adequately addressed issues of selenium pollution which has been brought against the phosphate mine by environmental groups such as the Greater Yellowstone Coalition.  Ultimately, the three-judge panel ruled that the agencies not only fully evaluated the situation but also disclosed their findings to the public.
